These Terms of Service (“Terms”) govern your access to and use of the Tiger Elements websites, account portal, plugins, and related services (together, the “Services”) operated by Tiger Elements (“we”, “us”, “our”). By creating an account, purchasing a license, or using any of our plugins, you agree to these Terms.
1. Acceptance of these Terms
If you are using the Services on behalf of a company or other organization, you represent that you are authorized to bind that organization to these Terms, and “you” refers to that organization. If you do not agree with these Terms, do not use the Services.
2. Your account
To purchase or manage a license you must create an account at accounts.tigerelementswp.com and verify your email address. Your licenses are linked to your verified email address, so you are responsible for keeping that address, your password, and any two-factor authentication devices secure. You must notify us promptly of any unauthorized use of your account. You must be at least 16 years old, or the age of digital consent in your jurisdiction, to hold an account.
3. Licenses and activations
When you purchase a Tiger Elements product you receive a non-exclusive, non-transferable license to install and use that product, subject to the tier you purchased:
- Activation limits. Each plan permits activation on a set number of live WordPress sites (for example Personal, Starter, Freelancer, or Agency). Staging and local development installs do not normally count against your limit where the product supports a development flag.
- Annual licenses grant updates and support for the term purchased and renew until cancelled.
- Lifetime licenses grant a perpetual license to the product together with updates and support for as long as the product line is actively maintained.
- Entitlements. A license unlocks only the product(s) it was sold for. An all-access license unlocks the full suite covered by that plan.
You may not sublicense, resell, redistribute, or publish the pro code of our products, nor circumvent or attempt to circumvent the licensing, update, or activation systems.
4. Payment and billing
Orders are processed by our reseller and Merchant of Record, Paddle (Paddle.com Market Ltd and its affiliates). Paddle handles payment, billing, sales tax and VAT, and issues your invoice. Your purchase is therefore also subject to Paddle’s Buyer Terms. Prices are shown at checkout in the applicable currency and may change over time; the price you see at checkout is the price you pay for that order. Annual plans renew automatically at the then-current rate unless cancelled before the renewal date.
5. Refunds
Because our products are digital and delivered immediately, we offer a 30-day refund from the date of purchase if the product does not work as described and we are unable to resolve the issue for you. Refund requests are handled together with Paddle. Refunds may be declined where there is evidence of license abuse, redistribution, or where the request falls outside the refund window. A refund revokes the associated license and its activations.
6. Updates and support
An active license entitles you to product updates and to support through our support desk while the license is valid. Support covers installation, configuration, bug reports, and reasonable how-to guidance for our products. It does not include custom development, third-party themes or plugins, or server administration. We aim to respond to every ticket but do not guarantee a specific resolution time.
7. Acceptable use
You agree not to use the Services to: (a) break any law or infringe anyone’s rights; (b) distribute malware or attempt to gain unauthorized access to our systems or other users’ data; (c) resell or redistribute our software outside the license granted; (d) abuse the affiliate program; or (e) place unreasonable load on, probe, or interfere with our infrastructure. We may suspend access to protect the Services or other users.
8. Intellectual property
The Tiger Elements name, logo, websites, and the non-GPL assets of our products are our property or that of our licensors. Where our plugin code is distributed under the GNU General Public License (GPL), your rights in that code are as stated in the GPL; the license key, hosted services, brand assets, and premium distribution remain governed by these Terms.
9. Affiliate program
If you join our affiliate program you may earn commission on qualifying referred sales. Commissions are earned only on completed, non-refunded orders attributed to your referral link or promo code, and become payable after the refund/hold window has passed. Self-referrals, fraudulent traffic, unauthorized coupon or trademark bidding, and other abuse void the affected commissions and may result in removal from the program. Payouts are made to the payout details on your account once the minimum threshold is met.
10. Warranty disclaimer
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or compatible with every third-party theme, plugin, or hosting environment.
11. Limitation of liability
To the maximum extent permitted by law, Tiger Elements will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim relating to the Services is limited to the amount you paid us for the product giving rise to the claim in the 12 months before the claim.
12. Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, including the license and acceptable-use sections. On termination for breach, the license granted to you ends and you must cease using and remove the affected products.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you by email or in the account portal. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
